  1. The Smart Back Up Contract Concept, here's how it works:

    If you submitted an offer to buy a property and you were advised by the seller or the agent that the seller had accepted an offer from another party, most people would move on and try to find another investment. But don’t be too quick to do so! You might find that after lamenting your loss to a local real estate agent, you were informed that the buyer who beat you to the property didn’t proceed with the last two properties that they submitted offers on because they were unable to get the finance. The local agent might be doubtful therefore about the buyer’s ability to follow through with the property that you were looking at.

    Why not then submit a Backup Contract, which includes a special clause along the lines that if the first purchase doesn’t proceed, the property is yours.

  2. The Solicitor's Approval Special Clause Tip, - here's how you could implement it:

    If you see a property on a Saturday afternoon and you want to make an offer to buy it but are reluctant to sign a contract before your solicitor has checked it first.

    Why not sign the contract with a special condition which makes it subject to your solicitor’s approval by 5.00pm on Monday. Most sellers will sign on that basis and at least then the property will be taken off the market so that it cannot be purchased by someone else on the Sunday or Monday before you get to see your solicitor.

    In practice, 9 times out of 10 a solicitor will sign off on the contract before 5.00pm on Monday. A cynic may reject the clause outright, however, you may be surprised by how many times the contract is approved by the solicitor concerned and you end up with the deal.

  3. The Little Used Early Access Clause You Need To Know About

    If you are purchasing a property to renovate or redevelop, then ‘time is money’. It is important that from the date you settle the property, you are in a position to proceed immediately with the renovations or redevelopments as ‘run-ons’ can be very expensive. You should therefore include a clause in your offer to purchase the property which gives you access immediately after you sign the contract, to get quotes from tradesmen and suppliers so you are ready to start work from settlement date.

  4. The Asbestos Protection Clause, A Real Lifesaver

    30 or 40 years ago asbestos was heralded as the new wonder building product. Construction of houses with asbestos was going to drastically reduce the cost of building and it was thought to be the building product of the future. Now of course, we know that asbestos can seriously harm your health and even kill you. If you suspect the property contains any asbestos at all, it is vital that the contract be made subject to an asbestos check.

  5. The "Make Sure You Are Actually Getting What You Think You Are Getting" Survey Clause

    If you are purchasing a property which you propose to develop e.g. by constructing a small block of three units, the local authority will usually require that the land be of a minimum size to allow you to construct that number of units.

    Therefore, if the block was 10 square metres less than what you believed when you signed the contract, this may prohibit you from building the third unit. This will mean a loss of all of your profit from the development. It is essential therefore to make the contract subject to you carrying out a survey and being satisfied with the outcome of the survey.
